PIL in Punjab and Haryana HC against MHA guidelines permitting 50 persons in marriage functions | Chandigarh News – Times of India

CHANDIGARH: A public interest litigation (PIL) has been filed in the Punjab and Haryana high court challenging the provisions of MHA guidelines dated May 17, which permit up to 50 guests in marriage related functions during current lockdown period. The MHA, states of Punjab and Haryana and UT Chandigarh administration have been made as respondents in the PIL, which is expected to come up for hearing next week.
The matter has reached before the HC in the wake the petition filed by advocate HC Arora, a practicising lawyers in the high court Chandigarh.
The petitioner has referred to case of Bapu Dham colony, Chandigarh, where a few persons had attended a marriage anniversary function, which led to spreading of Corona virus amongst 129 persons. Thus, marriage related functions pose a great danger of Corona virus to grand parents, pregnant ladies, and small children up to 10 years of age, who are required to stay at home, during lock down period, being vulnerable persons, as defined and mandated under guidelines dated May 17, 2020, whereas these categories of persons are the star attraction of such functions. Otherwise too, it is not practicable to ensure maintenance of social distance in such functions, which involve milnis (Hugging each others’ relatives), dining and wining, and cake-sharing etc, and due to the nature of various other ceremonies involved.
The petitioner has also stated that impugned provision of guidelines is prone to misuse, as it permits upto 50 “guests” in marriage related functions, which means hosts shall be in addition to aforesaid numbers, while in relation to cremations, the word “persons” has been used in the relevant clause. In marriage related functions thus, band walas, bride’s relations, caterers/decorators are not to be included in the maximum number mentioned in the guidelines. The impugned guidelines are thus, in gross violation of letter and spirit of fight against Corona virus, and deserve to be reviewed downwards, and more than 20 persons should not be permitted to participate in marriage related functions.
